Planning to rent out a property in the private sector? Here's what you need to know

Are you planning to rent out a property in the private rental sector? Or are you already doing so, furnished or unfurnished? Then it’s important to be aware of the new housing points system that has been in effect since July 2024. The government has significantly tightened the points system for rental properties, particularly to better regulate prices in the private sector. This could have a major impact, especially if you're renting out a smaller property of less than 65 m².
From social housing to the private sector: What has changed?
The rental market in the Netherlands is divided into social housing, mid-range rent, and the private sector. The category your property falls into is determined by the housing valuation system (WWS), more commonly known as the rental points system. Since 2025, the rules for private sector rentals have become stricter. As a result, a property that could previously be rented out in the private sector without issue may now fall under regulated rent.
The new rental point system includes factors such as:
- The surface area of the property
- The energy label
- The quality of the finishes
- Outdoor space
- WOZ value (capped at 33% of the total score)
- Renovation investments
Renting furnished? New rules apply here too.
Do you rent out a furnished property? Then you need to pay extra attention. Within the updated rental points system, only a limited number of extra points can be added for furnishings. Simply adding a couch and bed won’t push your property into the private rental sector anymore. The basics need to be in good shape: energy-efficient, sufficiently spacious, and well-finished.
Private sector or regulated rent?
As of 2025, the classification is as follows:
- 0 to 143 points: social housing
- 144 to 186 points: mid-range rent (regulated, with a maximum rental price)
- 187 points and above: private sector (freely negotiable rent)
The maximum initial rent allowed in the mid-range category in 2025 is €1,184.82. If your property falls into this category, you may not exceed this rental amount.
Mandatory from 2025: provide the point report
Since 2025, you are required to provide tenants with a printout of the rental points calculation when signing a new lease, even if the property is in the private sector. This helps prevent misunderstandings and legal issues later on.
